1. About Sesotho Fashioneng

Sesotho Fashioneng ("SF") is a premium Basotho streetwear brand operating in Lesotho and South Africa. Our online store is operated at sesothofashioneng.co.za.

2. Acceptance of Terms

By browsing this Site, adding items to your cart, or placing an order, you agree to be bound by these Terms & Conditions in their entirety. If you do not agree, please do not use this Site or place an order.

These Terms apply to all orders placed via this website, via WhatsApp, or any other channel operated by Sesotho Fashioneng.

3. Products and Pricing

• All prices are displayed in South African Rand (ZAR / R) and include VAT where applicable.
• Prices are correct at the time of display. We reserve the right to change prices without notice, but any price change will not affect orders already confirmed.
• Product images are representative. Colours may vary slightly due to screen settings.
• Product descriptions are accurate to the best of our knowledge as required by the Consumer Protection Act, 68 of 2008.
• Availability is subject to stock. We will notify you if an ordered item is unavailable and provide a full refund or alternative.

4. Order Process

Placing an order on this Site constitutes an offer to purchase. Your order is confirmed only once you receive an order confirmation email or WhatsApp message from us.

You may correct your order at any time before completing checkout by adjusting your cart. Once payment is submitted, please contact us immediately via WhatsApp if you need to make changes.

WhatsApp orders: Orders placed via WhatsApp (+27 78 110 8296) are governed by these same Terms & Conditions.

5. Payment

• We accept Visa and Mastercard (processed securely by iVeri / NedSecure, a Nedbank product).
• We accept M-Pesa mobile payments via Vodacom Lesotho.
• Payment via WhatsApp can be arranged for EFT or other methods — contact us.
• All card payments are processed on PCI-DSS compliant infrastructure. We do not store your card details.
• Payment is due in full at the time of ordering. No layby or credit terms are offered unless separately agreed in writing.

6. Delivery

• We deliver to Lesotho and South Africa.
• Free shipping on all orders over R 500.
• Estimated delivery: 3–7 business days after order confirmation, subject to courier availability.
• We will provide tracking information where available.
• SF is not liable for delivery delays caused by courier partners, customs, or events outside our control.
• Risk of loss passes to you upon delivery.

7. Returns, Exchanges & Cooling-Off Right

7.1 Cooling-Off Right (ECT Act, Section 44)

As required by the Electronic Communications and Transactions Act, 25 of 2002, you have the right to cancel this agreement without reason and without penalty within 7 (seven) days of receiving the goods. To exercise this right, notify us in writing via email (266penyaplay@gmail.com) or WhatsApp within 7 days of delivery. We will arrange collection and issue a full refund within 30 days of receiving the returned goods in their original condition.

7.2 Exchanges

We offer exchanges for sizing issues within 14 days of delivery. Items must be unworn, unwashed, and in original packaging. Contact us via WhatsApp to arrange.

7.3 Defective Items

As required by the Consumer Protection Act, 68 of 2008: if your item is defective, does not match its description, or is not fit for its intended purpose, you are entitled to a replacement, repair, or full refund within 6 months of purchase. Contact us immediately with photos of the defect.

7.4 Non-Returnable Items

For hygiene reasons, headwear (bucket hats) may only be returned if defective or unworn. Custom or personalised orders are non-returnable unless defective.

8. Intellectual Property

All content on this Site — including brand name, logo, product designs, photography, copy, and the Megahurtz chatbot persona — is the intellectual property of Sesotho Fashioneng. Reproduction, distribution, or commercial use without prior written consent is prohibited.

9. Limitation of Liability

To the maximum extent permitted by applicable law, SF's total liability to you for any claim arising out of or related to these Terms shall not exceed the amount you paid for the relevant order. We are not liable for indirect, consequential, or punitive damages.

Nothing in these Terms limits or excludes our liability for fraud, wilful misconduct, or any liability that cannot be excluded by law.

10. Dispute Resolution

In the event of a dispute, please contact us first at 266penyaplay@gmail.com or WhatsApp. We will make every effort to resolve disputes amicably within 14 days.

If we cannot resolve the dispute, it may be referred to the Consumer Goods and Services Ombud (CGSO) in South Africa, or the relevant consumer protection authority in Lesotho.

11. Governing Law and Jurisdiction

These Terms are governed by the laws of Lesotho, with due consideration of applicable South African legislation including the Consumer Protection Act (CPA, 68 of 2008) and the Electronic Communications and Transactions Act (ECT Act, 25 of 2002) for customers based in South Africa.

Any legal proceedings shall be instituted in the courts of Maseru, Lesotho, unless applicable law requires otherwise.

12. Changes to These Terms

We reserve the right to update these Terms at any time. Changes will be posted on this page with a revised effective date. Continued use of the Site after changes constitutes acceptance of the updated Terms.
